In the most recent Kings speech, the new Labour government has outlined its proposals for a new Renters Rights bill, to replace the previous governments Renters Reform legislation attempts. The Renters Reform bill had been working its way through parliament before the election and it has been widely reported the Labour legislation will contain many of the same changes, with its first reading expected sooner rather than later.

Many of the changes in this legislation will impact greatly on private landlords who are ill-prepared, especially those with multiple properties. One of the key features of the new legislation will be the inclusion of the “Decent Homes Standard”, which legally obliges landlords to set a minimum standard for all social housing properties in England and Northern Ireland. One of the standard requirements for a property to meet the expectations of the “Decent Homes Standard” is to ensure the property is in “a reasonable state of repair”, in particular building components such as roofing, roof tiling, chimneys and guttering.

New legislation will also include the introduction of “Awaab’s Law”, the name given to Section 42 of the Social Housing (Regulation) Act 2023, which introduces an implied term into social housing tenancy agreements to the effect that social landlords are required to fix reported health hazards within specific timeframes.

 

Proposals currently include introducing a legal duty on landlords to ensure their properties meet these standards, with any breaches therefore being considered a criminal offense.
